Welcome to PayU, thank you for using our service!

In order to use our services, you must understand and accept the following Terms and Conditions for PayU Payers (hereinafter "T & Cs") that apply to your relationship with PayU. We recommend that you carefully read and store or print a copy of this Agreement for your records.

As a Payer, it is essential that you refrain from accepting these T & Cs if you lack the legal capacity to do so or if you are a minor. PayU has no way of verifying that your acceptance is binding; hence, it will presume that it is.  

If, at the time of payment, you are re-directed to a PayU website and you agree to these T & Cs by checking the "I accept these T & Cs" box, and if, on the other hand, you pay through a PayU Merchant's website, that is, the Merchants that use PayU’s services and do show you that when paying, we will assume that you accept the content of these T & Cs posted on PayU's websites - Legal Section of the www.payu.com URL, or in any other URL set up by PayU for the matter.

6.1 PayU recognizes that as a Payer, your personal information belongs to you, and strives to protect your privacy and data confidentiality by the terms of this agreement and by the applicable law or regulation.

6.1 PayU will handle your personal information, such as email, phone numbers, mailing address, information related with your payment methods, such as card numbers, and computer data, such as IP, Cookies, etc., in compliance with its Privacy Policy, included in the Legal Section of our website URL: URL: www.payu.com or at the later arranged URL.

6.2 By accepting these T & Cs, you authorize us to process your personal information to:

6.3 PayU will ensure the adequate treatment of your personal information, yet shall be held harmless of personal data treatment by PayU Merchants, or third parties, which you have authorized to handle this data.

 

7. DISCLAIMER OF WARRANTY

8.1 PAYU OFFERS SERVICES UNDER A DEGREE OF COMPETENCE AND REASONABLE CARE.

8.2 PAYU SHALL NOT BE HELD LIABLE, IN CONTRACT OR TORT, FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR PUNITIVE DAMAGES, LOSS OF PROFIT OR OPPORTUNITIES, AMONG OTHER CONSEQUENTIAL DAMAGES ARISING FROM SERVICE UNAVAILABILITY, PAYMENT PROCESSING DELAYS, FRAUD BY IDENTITY THEFT AFFECTING THE PAYER OR MERCHANT, AND/OR ANY OTHER DAMAGES INDIRECTLY RELATED TO PAYU’S SERVICE DELIVERY, WHETHER PAYU MAY HAVE FORSEEN THE EVENT OR NOT.

8.3 PAYU IS LIABILE, IN CONTRACT OR TORT, FOR ANY PERSONAL AND DIRECT TRUE DAMAGES CAUSED BY ITS WILLFUL ACTIONS, OR DUE TO GROSS NEGLIGENCE.

8.4 PAYU'S LIABILITY IN SUCH EVENT SHALL NOT EXCEED THE AMOUNT PAID BY THE PAYER TO PAYU, WHEN PAYMENT ON A SERVICE HAS BEEN DELIVERED, OTHERWISE, THE MAXIMUM AMOUNT SHALL BE EQUAL TO FIFTY US DOLLARS $50.

 

9. TERMINATION

9.1 You may stop using PayU Services at any time.

9.2 Likewise, PayU may suspend PayU’s Services at any time if:

 

10. FINAL PROVISIONS

10.1 As a Payer you accept electronic form of communication to contact PayU, receive notifications and amendments to these T & Cs.

10.2 If any court, competent jurisdictional administrative body, or arbitral tribunal determines that any provision of these T&Cs or any part thereof is illegal, invalid or unenforceable, such provision or clause shall be deemed unwritten, without affecting the validity, legality, or enforceability of the remaining T & Cs.

10.3 You cannot transfer or assign this Agreement or any rights or obligations arising therefrom without PayU's prior and written authorization. PayU may however, without prior notice, transfer this contract or any rights or obligations arising therefrom to third parties.

10.4 PayU will not be violating or breaching any of its obligations arising through this contract, when an event of force majeure occurs. An event of force majeure means any event or situation that escapes or is beyond PayU's control.

11. APPLICABLE LAW AND JURISDICTION

11.1 The applicable law to settle disputes between PayU and Payer, will be the law governing PayU Company's domicile wherein the payment in question was processed.

11.2 Disputes arising herein shall be subject to the jurisdiction of competent courts in the PayU Country where the payment in question has been processed.

 

PayU
PROVISIONS FOR PAYU COUNTRIES


Provisions applicable to Argentina

(Only applicable to sales of products or services in Argentina)

 

1. Purchases paid in installments

Notwithstanding was is set forth in clause 2.1 of these T&Cs, PayU may charge you a processing fee for the use of the PayU platform, and a financing fee if you choose to defer the payment of your purchase. PayU will, in this case, display this charge within the check-out prior to performing your purchase.

2. Payments to Non-Resident Merchants

In case it is required by the regulations that govern the exchange market, you as a Payer grant E-Payments S.A. a power of attorney,. so that, on your behalf, and acting as your agent, it can access the exchange market, purchase the needed currency, and submit all documentation needed to pay the purchase price to any relevant non-resident Merchant, under the terms of this agreement.

3. RIGHT OF WITHDRAWAL.

AS A PAYER YOU CAN DECLINE THE PURCHASES PAID THROUGH THE PAYU PLATFORM. TO DO SO , YOU MUST SUBMITT YOUR REQUEST VIS A VIS THE MECHANT WITHIN THE TEN (10) DAYS FOLLOWING THE EXECUTION OF THE RELEVANT PURCHASE OR SERVICES AGREEMENT, AS THE CASE MAY BE. WHEN THE MERCHANT INFORMS US OF YOUR REQUEST, PROVIDED WE RECEIVED YOUR PAYMENT, AND HAVE THE FUNDS IN OUR POSSESSION, WE WILL DO WHAT IS REQUIRED FROM US, TO GRANT YOU A REFUND WITHIN THE 15 BUSINESS DAYS FOLLOWING YOUR WITHDRAWAL REQUEST.



Provisions applicable to Brazil

(Only applicable to sales of products or services in Brazil)

 

1. Special considerations applicable to PayU buyers in Brazil

1.1 By using PayU’s Platform, the Buyer grants PayU a payment management authorization, enabling PayU to receive the value of goods or services purchased from Merchants, on the Buyer’s behalf, and send such amounts to the destination established by the Buyer under the terms of this Agreement, in order to pay such product or service.

1.2 PayU may, upon detecting the destination requested by the Buyer of the sums received, refrain from executing the payment order given by Buyer, in which case, it shall return the due sums to Buyer, according to the methods available in the National Financial System.

 

2. Right of withdrawal.

As a Payer who pays a product or service through the PayU Platform you may exercise vis a vis the Merchant the right of withdrawal provided for in Article 49 of the Consumer Protection Code, within seven (7) days of your purchase or delivery of the product or service, as the case may be. Accordingly, you must inform the Merchant of your intention to decline the purchase and follow the procedure set forth by the Merchant to do so. Provided we have received your payment and have the funds in our possession, we will, along with the other participants in the payment chain, do what is required from us, to refund the amount paid within the 15 business days following your withdrawal request.

 

Provisions applicable to Colombia

(Only applies to sales of products or services in Colombia)

1.PayU Means of Payment: PayU Te Fía (PayU Lends You)

    1.1 As a customary payer you can be, in particular purchase(s) and by the exclusive decision of PayU, the beneficiary of the PayU means of payment: PayU Lends You.

    1.2 PayU Lends You is an eventual or frequent benefit, as PayU may consider it, consisting in giving you as the customary payer and for your benefit, the possibility to pay your purchase for up to 14 calendar days without charging remunerative interest.

    Only in the case that after the expiry of the period of 14 days without payment by the payer, that is, from the day 15 onwards, an interest at the maximum rate permitted by law will be charged. The value to be paid, in the event of interest on arrears, will be updated as appropriate and in accordance with the parameters laid down in the Colombian legislation.

    The period shall be computed from the day of the confirmation of the purchase(s) using the benefit through email confirmation by PayU of the transaction submitted to the Payer, once the process of the transaction is effectively completed; and will end at 11:59:59 PM – Colombian time – of the  next 14th calendar day.    

    From that date, you must keep in mind that if you decide to accept the PayU Lends You benefit, you will be charged a processing fee of the PayU Lends You payment means. This commission has as its sole purpose to remunerate PayU for the use you make of its platform to pay for a good and/or service of a merchant which is customer of PayU; consequently, this commission does not pay for the use of the benefit as such.

    1.3 The decision to that PayU grants you with the benefit shall be informed at the time of selecting the means of payment and, if you decide so, you can use PayU Lends You among the means of payment of your purchase.

    1.4 PayU Lends You is an elective benefit in its concession on the part of PayU to the payers and optional in its use in the case of the payers. As a result, if at any time PayU decides to grant you the possibility to use the benefit for a certain purchase, the same shall not be required nor shall be extended to other purchases or services. The benefit shall not be granted automatically permanently or mandatorily to the payer in any case.

    1.5 PayU Lends You does not modify the terms and conditions of service and, therefore, if you use the benefit, the same is governed by the general conditions of use of payers, including the STATEMENTS OF THE PAYER.

    1.6 PayU Lends You does not alter the fact that, as you declare in the T & Cs, PayU has no responsibility with regard to the quality, safety, suitability and time of delivery of the goods or services sold by the PayU Merchants.

    1.7 PayU Lends You is a benefit that is granted, in the exclusive setting of PayU’s services, but without prejudice to the exercise of the rights of consumers with regard to the merchants in the events that a consumer relation is set up with them. Consequently, the use of the PayU Lends You benefit, does not affect in any manner the exercise of the rights of consumers with regard to the merchants (as solely responsible) such as the exercise of the right of withdrawal or reversal of payment, among others, when appropriate, in accordance with the parameters and requirements established in the Colombian legislation.

    1.8 The granting of the benefit is subject to your consent and authorization for the processing and use of your information, in accordance with text of the authorization set at your disposal and the applicable privacy policy. In particular, the viability of the benefit is subject to the analysis of your behavior with respect to payments and information in accordance with your authorization for the use of information related to your payment habits, movements and transactions through PayU, as well as merchants to which you have made payments with PayU, or any other related information and generated by your interaction with the payment platform and derivative transactions. The above bearing in mind that to determine the PayU You Lends benefit in your favor, the previous information will be used for the participation analysis and study, offered you by PayU.

    1.9 Once you are informed the grant of the PayU Lends You benefit and in the event that you accept this means of payment for the respective purchase, we will proceed in the following terms:

    • 1.9.1. The transaction shall be approved and you will receive an email with payment instructions and the link to make the same.
    • 1.9.2. You make the payment of the purchase price, paying through the PayU Lends You benefit and the commission for the processing of the means of payment, making use of the other means of payment provided and enabled by PayU, by following the link provided in your confirmation email.
    • 1.9.3. If you do not pay within 14 calendar days, you will receive an email with the new value due, which reflects the value of the purchase paid through PayU Lends You, the interest in arrears caused to the date on that value, and the value of the commission for the processing of the means of payment. The value will be updated on a daily basis in relation to the interest due on the value of the purchase, until payment is made.

    1.10 Without prejudice to the optional character and other requirements established for the granting of the PayU Lends You benefit, it will be applied - unless PayU modifies the restrictions - in observance of the following general criteria:

    • 1.10.1. PayU Lends You shall not apply to payers who have not had a good payment behavior of transactions with this means of payment in previous dealings.
    • 1.10.2. PayU Lends You shall not apply to payers from whom we do not have sufficient information to provide the service.
    • 1.10.3. PayU Lends You shall apply only if the payer has made at least one purchase through a merchant connected with PayU through      Web Checkout. This means that when you are in the web page of a merchant who is a customer of PayU from which you are purchasing a particular good and/or service, you are directed to PayU’s web page for payment processing.
    • 1.10.4. PayU Lends You shall apply only if the payer accesses PayU’s Web Checkout through a merchant who is a customer of PayU that has enabled the PayU Lends You means of payment.
    • 1.10.5. PayU Lends You shall apply only if the payer has been considered previously by PayU in order to obtain the benefit, in accordance with the applicable criteria.
    • 1.10.6. PayU Lends You will not apply in transactions that exceed the limit per transaction provided for by PayU, which may range between five hundred thousand pesos (COP$500.000) and one million pesos (COP$1, 000.000).
      In the event that the PayU Lends You option is not provided, you as payer understand that you don't meet the requirements to access the benefit.

    1.11 If you accept the PayU Lends You benefit, you agree to receive information via email that corresponds to, among others, payment date reminders, reminders of the value of payment, including the updated value in the event of arrears, among other information that is relevant and related to the PayU services and the PayU Lends You benefit. In the same way, you assume the responsibility for the review of the information you submitted to PayU, due to using the PayU Lends You benefit, as is to be careful not to give spam or junk mail classification to the messages, among others.

    1.12 If the benefit is granted and, in the event of default, you will receive information in the following terms:

    • 1.12.1 At the time of payment, you will receive an email confirming the transaction with the PayU Lends You means of payment.
    • 1.12.2 Within the time limit for payment of 14 days following your purchase, you will receive one or more email reminders about the payment of the total amount that you owe to PayU (which includes the value of the purchase paid with the PayU Lends You benefit, plus the value of the commission from processing of the means of payment), until you make a payment of that value.
    • 1.12.3 If you do not place the payment of the total value due within 14 days, you will receive one or more emails with weekly reminders of payment. These emails will include the value of the purchase you did using the PayU Lends You benefit, the value of the interest incurred up to the date on which the communication is sent and the value of the processing commission of the means of payment. PayU may contact you by phone or in writing, in addition to the mentioned mails, for the purpose of reminding you of the payment, in the event that it has expired.
    • 1.12.4 If after 30 days you don’t have made the payment of the total value due to PayU, we will send a written notice to the address provided in the transaction, specifying the steps to follow in the event of not receiving the payment. These steps may include notification to risk centrals.

    1.13 For payment purposes of the total value due to PayU within a period of 14 days that is given to you by the benefit, you just have to follow the instructions provided in your confirmation email.
    As the payer you understand that the payment, once the PayU Lends You benefit has taken place, is subject to the parameters set out above, without prejudice to the other forms which, according to Colombian law, are in place for this purpose.

    1.14 For the purposes of making the payment of the total value due to PayU once the term of 14 days is over, you will need to take into account the updated value to the date of payment in question, according to the interest due on the value of the purchase made using the PayU Lends You benefit until that time.

    1.15 For subsequent payment to the term granted by the PayU Lends You benefit, you simply must follow the payment link provided in any of the emails received in reference to this transaction. This link will take you to our checkout and will reflect the total value to pay to date, which includes the value of the purchase, the interests on arrear due on the value of the purchase to date, plus the value of the processing commission by the means of payment.
    As the payer you understand that the payment, once the PayU Lends You benefit has been executed and in the event of arrears, is subject to the parameters set out above, without prejudice to the other forms which, according to Colombian law, are established for this purpose.

    1.16 Without prejudice to any legal action or prelaminar legal actions that correspond, in the event of non-payment within a period of 14 days, in addition to the effects related to collection of interests on arrears on the value of the purchase and transfer of information, you agree that PayU, will proceed to report you with the risk centrals.  To this end, PayU, together with the acceptance of these T & Cs, and at the time of obtaining authorization for the use of your information as the payer, has obtained your prior, express and informed consent to access, consult, compare and evaluate information about you that is stored in the databases of any credit risk and financial central, or any commercial database or service that allows to establish your behavior as a debtor, user, customer, head of financial, commercial or any other kind of services. Likewise, you have authorized PayU to report your information and behavior on monetary obligations to credit risk, financial, commercial or services centrals which are legitimately constituted, or to other financial institutions, in accordance with the law 1266 of 2008 and other applicable rules.

    1.17 Occasionally, PayU may amend the special provisions for PayU Lends You when it deems necessary. If you do not agree to these amendments made by PayU, you must refrain from using the PayU Services and accept or use the PayU Lends You benefit in the future.
    The benefits granted and in force prior to the respective payment, are subject to the terms and conditions in effect at the time of executing the benefit in the respective purchase.

     

    2. Privacy and Treatment of personal data.

    For the personal data treatment of users located in Colombia and that will be processed by the PayU Company constituted in Colombia (PayU Colombia S.A.S.) the following texts will be observed, corresponding to the authorization and the information treatment policy or privacy policy:

     

    AUTHORIZATION FOR INFORMATION TREATMENT

    In order to comply with the Law 1266 of 2008 and Law 1581 of 2012 and other related and complementary rules, PayU Colombia S.A.S. ("PayU" or the "Company") domiciled in the city of Bogotá, in the Calle 93B No. 17-25 Office 301, informs you that it acts as Responsible for your personal data and financial data collected through the platform and/or transactional channel and/or through the payments made by the PayU payment system. As a result, by  clicking on acceptance you recognize that you know the Privacy Policy included in this document and available at here , and that you know and you authorize in a free, prior and informed manner that

    1. The information that you provide when you open a PayU account or when proceeding with a payment to a merchant linked to PayU, from which you have purchased a product or service and which may correspond to identity information such as name, email address, contact number, home address, as well as banking and payment information (for example, credit card information, account number, among others), to be used either directly by PayU or by authorized third parties like merchants, means of payment issuing financial institutions, acquisition franchises such as Visa and MasterCard, among others, will be used for billing, payment processing and/or that the processed transaction is accepted or rejected. It also will be subjected to treatment by PayU through PayU’s databases and systems, managed directly by PayU or by third parties, authorized according to the needs of the business, in order to validate transactions, verify your identity, and mitigate the risk of identity theft of the card holders. All under strict security and confidentiality. 

    2. Information related to your payment habits, movements and transactions through PayU, as well as merchants where you have made payments with PayU, or any other related information and generated by your interaction with the payment platform and  derivative transactions, will be used for the analysis and feasibility study and participation, offering of promotions, benefits, products and services by PayU, which in the judgment of PayU are beneficial for you and may improve your interaction and use of PayU and/or of future developments. Your information will be subject of the treatment that is necessary for the development of the social object of the Company, always under guidelines of the required security, confidentiality and protection, according to applicable valid regulation.

    3. Your collected information, subjected to treatment, will be used to send you information that we believe may be of interest to you, like overall marketing efforts, advertisements, offers, promotions, surveys, or other processes aimed to let you know about PayU’s services, both current and future.

    4. The treatment of your information, whether through a transmission or international transfer, and which may occur in other countries (such as, but not limited to, Argentina, Brazil, Mexico, Chile, Peru and Panama) or by third parties of one or any of PayU’s companies or by PayU’s third-party service providers, in order to be able to provide PayU’s services, or meet other operational needs, in accordance with the applicable terms and conditions. PayU will ensure that these countries and third parties offer adequate protection levels of your information.

    5. To provide an assistance and problem solution service.

    6. To prevent that PayU’s system is used for illegal activities and to enforce the use of our system’s Terms and General Conditions.

    7. To customize, measure and improve the services provided by PayU, our web pages and to access PayU’s services.

    8. To compare information to verify its accuracy.

    9. To inform you about faults and service updates.

    10. To contact you or send you notifications, if necessary. PayU respects your preferences in relation to the means of communication and contact. If you do not want to receive notifications via text messages on your device, or if you prefer to receive them through a single communication channel, for example by e-mail, you can let us know by contacting us directly.

    11. To resolve disputes.

    12. To use your personal information for internal purposes such as auditing, data analysis and research to improve the products, feasibility studies in terms of sales, lending, analysis of your behavior in the face of monetary obligations that relate to PayU’s services and communications with the users of PayU’s services.

    13. To store your personal data for as long as it is required for the fulfilment of the purpose for which it was collected and in accordance with the trade laws or privacy and protection of personal information that may be applicable.

    14. To store and to have the information related to your electronic equipment at your disposal, if you are a payer, in case that you need to make payments, as well as your means of payment, such as credit card numbers, security codes, as long as you decide to make use of the storage features such as "PayU Click" or similar ones. Your credit card data will be saved by PayU, taking into account the information safety and protection standards established by the regulations of the Payment Card Industry (PCI DSS), which you can consult at pcisecuritystandars.org.

    15. To request your opinion or participation in electronic surveys.

    16. Send you communications and commercial and advertising information from PayU’s companies, merchants registered in PayU and from third parties that include promotions for the purchase of goods or services through PayU.

    17. To organize and conduct contests, games, offers or promotional or marketing operations, and similar events from PayU and/or businesses linked or not to PayU.

    18. To send you discount coupons or provide benefits for future purchases through PayU. 

    19. To propose your affiliation to loyalty programs, create user consumer profiles, and send you promotional and advertising materials that may be of interest to you.

    20. PayU will request your consent before using your personal information for any purpose other than those set forth in this authorization and corresponding to the Privacy Policy.

    21. PayU will collect your personal data in its respective databases or personal data banks and will give them the treatment set out in this authorization and the related Privacy Policy.

You also authorize PayU to access, query, compare and evaluate information about you, that is stored in the databases of any central credit risk, financial, or any commercial database or service that allows to establish your behavior as a debtor, user, customer, head of financial or commercial services of any other kind, when required for developing and offering innovative products and services. At the same time, and as applicable, you are consenting PayU to report your information and behavior on monetary obligations to legitimately constituted credit risk, financial, commercial or services centrals, or to other financial institutions, in accordance with the law 1266 of 2008 and other applicable regulations.

By clicking on acceptance you express that the data supplied are true, that you have not omitted or altered any information. This authorization is extended to those who represent the rights of PayU, to whom is recruited to exercise them, or to whom it assigns its rights, obligations or contractual position to any title. This authorization will remain in effect until revoked, in accordance with the events foreseen in the law, and may not be revoked in whole or in part, in effect with the relation or pursuant to the legal norms that require the company to keep it stored.

At any time you can exercise the right to know, update, rectify and delete your personal information, as well as to request proof of authorization, revoke the same, and submit claims to the Responsible or start processing complaints at the Superintendence of Industry and Commerce. THE AUTHORIZATION TEXT FOR YOUR ACCEPTANCE HERE ENDS. IN CASE YOU ARE NOT GRANTING YOUR CONSENT, WE WILL NOT BE ABLE TO PROVIDE YOU WITH PAYU’s SERVICE.

 

BELOW IS THE PRIVACY POLICY FOR YOUR QUICK KNOWLEDGE AND CONSULTATION.

 

This Policy came into effect on September 2, 2016, replacing the policy which was valid up to that date.

 

3. Right of withdrawal.

As a Payer you can decline certain purchases made through the PayU Platform. To do so you must ground your request as set forth by the Consumer Statute. You must submit your withdrawal request vis a vis the Merchant and notify the issuing entity of the payment instrument of your withdrawal request, within five (5) days following the execution of the services contract, the delivery of the good, or the expiration of the deadline to receive it, as the case may be. In this case, and if applicable, we will do what is required from us to refund you , along with the other payment participants for the price paid, within fifteen (15) business days following your withdrawal request.

Provisions applicable to Chile

(Only applicable to sales of products or services in Chile)

1. Right of withdrawal.

As a Payer, you may decline purchases made through the PayU Platform, if the Merchant has not expressly provided otherwise, as set forth in article 3 bis letter b) of Consumer Protection Law. To do so, you must unilaterally terminate vis a vis the Merchant the purchase or services contract, by the same means used to execute it. If the Merchant sent you a written confirmation of the contract’s execution, you must terminate within a 10 days term counted as from the receipt of the goods or the execution of the services contract, as the case may be. If not, you will have a 90 days term to do so. After the Merchant notifies us of your withdrawal request, provided that we have received your payment and have the funds in our possession, we will do our part to refund the amount paid, within 45 days counted as of your withdrawal request. If the funds have been transferred to the Merchant, refunds are to be performed by the Merchant. Refunds in regards to services will not include amounts paid for services already rendered at the date of the withdrawal request.

 

Provisions applicable to Mexico

(Only applicable to sales of products or services in Mexico)

1. Right of withdrawal.

As a Payer you can, in accordance with the provisions of the Federal Consumer Protection Law, withdraw your consent regarding transactions paid through the PayU platform. To exercise this right you must send a notice or deliver the goods in person, by registered mail, or by other consistent means to the Merchant within five (5) business days following the date of delivery of the goods or the date of purchase, whichever is later. In this case, the costs of freight and insurance to return the product will be at your expense.

In the case of services, you may exercise your right only if there is a period of more than 10 (ten) business days between the contracting of the service and its rendering.

As soon as the Merchant notifies us, and as long as we still have the funds derived from your payment in our possession, we will do our part to refund the amount paid within the 15 business days following your withdrawal request vis a vis the Merchant.

2. Purchases paid in monthly installments

PayU may offer you the service of deferring your payment for purchases made in 3, 6, 9, 12, and 18 monthly installments. In this case, notwithstanding clause 2.1 of these T & Cs, PayU will charge you a single additional charge on the amount of your purchase that will be displayed within the check out, prior to your payment.
